1. Introduction
These Terms of Service (“Terms”) govern your use of the website olivetreeflorist.co.uk (the “Service”) operated by Olive Tree Florist (“we,” “us,” or “our”). By accessing or using our Service, you agree to be bound by these Terms. If you do not agree, please do not use our Service.
2. Products and orders
2.1 Product descriptions
We take care to describe and photograph our bouquets and products accurately. However, because our flowers are seasonal and hand-tied to order, each bouquet is unique. The arrangement you receive may differ slightly from the photograph shown on our website in terms of specific stem varieties. The overall style, colour palette, size, and quality will always match what you ordered.
2.2 Pricing
All prices are listed in British pounds sterling (£) and include VAT at the applicable rate where stated. Delivery charges are calculated at checkout based on your delivery postcode and selected delivery window. We reserve the right to change prices at any time, but price changes will not affect orders already confirmed.
2.3 Order acceptance
Your order constitutes an offer to purchase. We reserve the right to refuse or cancel any order for reasons including but not limited to: product unavailability, errors in pricing or product descriptions, suspected fraud, or inability to deliver to your address. If we cancel your order, we will notify you and issue a full refund.
3. Delivery
3.1 Same-day delivery
Same-day delivery is available across all 32 London boroughs for orders placed before 2 PM (Monday to Saturday). Orders placed after 2 PM, or on Sundays and bank holidays, will be delivered on the next available working day unless otherwise stated.
3.2 Delivery windows
We aim to deliver within your chosen delivery window. However, delivery times are estimates and not guaranteed. Factors including traffic, weather, and courier availability may affect delivery timing. We will notify you of any significant delays.
3.3 Recipient not available
If the recipient is not available at the delivery address, our courier will attempt to leave the bouquet in a safe place or with a neighbour. We will notify you by SMS with a photo of where the flowers were left.Olive Tree Florist is not responsible for flowers left unattended at the recipient's request or in a safe place.
4. Cancellations and refunds
Because our flowers are perishable goods, the right to cancel under the Consumer Contracts Regulations 2013 does not apply. However, we want you to be delighted with your flowers.
- Before dispatch: You may cancel your order for a full refund up to 2 hours before your scheduled delivery window.
- After delivery: If your flowers arrive damaged or do not match your order in a material way, please contact us within 24 hours of delivery with a photograph. We will arrange a replacement or full refund at our discretion.
- Non-delivery: If we fail to deliver your order, we will provide a full refund including delivery charges.
- Change of mind: We cannot accept returns or offer refunds for change of mind on perishable floral products.
5. Subscriptions
Our Olive Club subscription renews automatically at the frequency you select (weekly, fortnightly, or monthly). You may cancel your subscription at any time up to 48 hours before your next scheduled delivery. Cancellations received within 48 hours of delivery will take effect from the following delivery cycle.
6. Intellectual property
All content on this website — including text, photographs, illustrations, logos, brand names, and the Olive Tree Florist name — is our exclusive property or used under licence. You may not reproduce, distribute, or create derivative works from any content without our prior written permission.
Olive Tree Florist is a registered trading name. The Olive Branch, The Grower Series, The London 32, Sunday Papers, and The Olive Club are trademarks of Olive Tree Florist.
7. Limitation of liability
To the fullest extent permitted by law, Olive Tree Florist shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of our Service or products. Our total liability for any claim relating to an order shall not exceed the amount paid for that order.
Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, fraud, or any liability that cannot be excluded by UK law.
8. User conduct
You agree not to:
- Use our Service for any unlawful purpose or in violation of any applicable laws.
- Submit false, misleading, or fraudulent information.
- Interfere with or disrupt the operation of our Service.
- Attempt to gain unauthorised access to our systems.
9. Changes to these terms
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the “Last updated” date. Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms.
10. Governing law
These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the English courts.
